Protecting your privacy is important to us. With this in mind, Lift Innovations Inc. (“Lift Innovations” “Company” “we” or “us”) is providing this Privacy Policy to explain our practices regarding the collection, use and disclosure of information that we receive through our online store and website located at https://lift-innovations.com/ (the “Website”) and our Services. This Privacy Policy does not apply to any third-party websites, services or applications, even if they are accessible through our Services. Unless we define a term in this Privacy Policy, all capitalized terms used in this Privacy Policy have the same meanings as in our Terms of Service. So, please make sure that you have read and understand our Terms of Service.

 

SECTION 1 - WHAT DO WE COLLECT?

We aim to collect, use and disclose only such information as is required to enable us to manage your account, to provide the Services, to maintain our customer/visitor lists, to respond to your inquiries or provide feedback, for identification and authentication purposes, and for service improvement. We will maintain the confidentiality of any contact information you provide to us on signing up for our Services or contacting us with questions or for further information and we will use it only for the purposes for which we have collected it (subject to the exclusions and disclosures we have listed below), unless you agree that we may disclose it to other third parties. 

Two types of information may be collected through the Website and our Services: Personal Information and Non-Personal Information. This Privacy Policy does not extend to the collection, use or disclosure of the following information which is currently not limited by applicable privacy laws: (a) information that is publicly available, such as names, addresses, telephone numbers and electronic address when listed in a directory or made available through directory assistance; or (b) Non-Personal Information (as defined further below).

 "Personal Information" is personally identifiable information, such as your name, address, e-mail address, credit card information, birth date and gender. At the time of collection, we will clearly identify the information being collected and the purposes for which it will be used. It is always your choice whether or not to provide Personal Information but if you choose not to provide certain requested Personal Information, in some instances you may not be able to use certain features of the Website. We may collect Personal Information in respect of the Website through registration processes; communications with you; user support; and surveys.

"Non-Personal Information" is information of an anonymous nature, such as an Internet Protocol Address (IP Address) that has been stripped of personal information, the domain used to access the Website, and the type and version of browser or operating system being used by visitors to the Website. Aggregate information, such as demographic statistics of our users (e.g. average age or geographical allocation of our users), number of visitors, what pages users access or visit, and average time spent on the Website is not considered Personal Information. Similarly, business contact information such as the name, title, business address, or telephone number of a business or professional person or an employee of an organization is not considered Personal Information. 

Although the use of certain Non-Personal Information collected, used or disclosed through the Internet as described herein is not restricted (and to the extent that such is the case, the obligations under this Privacy Policy do not apply to such information), we provide information in this Privacy Policy about the collection of such information for the sake of transparency with respect to the operation of the Website. Such Non-Personal Information is collected or derived by us in the course of operating this Website. For example, our web servers may automatically collect Non-Personal Information that is provided through your browser or stored in a cookie when you choose to visit the Website.

  

SECTION 2 ­ WHAT DO WE DO WITH YOUR INFORMATION?

When you create an account with us or purchase something from our store, as part of the buying and selling process, we collect the Personal Information you give us such as your name, address and email address. This information may be stored on our servers, regardless of whether you make a one-time purchase or register an account with us. When you browse our Website, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about where our visitors come from. 

Email marketing (if applicable): If you opt-in to receive marketing communications from us, we may send you emails about our store, new products and other updates. When you receive such promotional communications from us, you will have the opportunity to unsubscribe or “opt-out” by following the unsubscribe instructions provided in the email you receive. Our newsletter service is operated through MailChimp, a third party service, so your email address may be stored on their servers and therefore subject to their privacy policy.

Transactional Emails: We do need to send you certain communications regarding the Services, despite your indicated email preferences, and you will not be able to opt out of those communications – e.g., we will send you communications regarding updates to our Terms of Service or this Privacy Policy or information about billing.

 

SECTION 3 ­ CONSENT 

How do you get my consent?

When you provide us with Personal Information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, or to post a comment on our Website, you do so subject to the terms of this Privacy Policy which you must agree to before providing such information to us.

If we ask for your Personal Information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

SECTION 4 ­ DISCLOSURE

We may disclose aggregated information about our users, or information that does not identify any individual.

We may disclose personal information we collect or you provide:

  • To our subsidiaries and affiliates.
  • To contractors, service providers and other third parties we use to support our business, such as website hosting, cloud service providers, developers and analytics providers.
  • To a buyer or other successor if a merger occurs, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Company’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by Company about our Website users is among the assets transferred.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
  • To comply with any court order, law or legal process, including to respond to any government or regulatory request. Our servers are hosted by GoDaddy.com LLC in the United States and accordingly your information may be available to US government or its agencies under a lawful order, irrespective of the safeguards we have put in place.
  • To enforce our Terms of Service and other agreements, including for billing and collection.
  • If disclosure is necessary or appropriate to identify, contact, or bring legal action against someone who may be causing injury to or interference (either intentionally or unintentionally) with our rights or property, our safety of Company, our customers or anyone else who may be harmed by such activities. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

 

SECTION 5 ­ THIRD­PARTY SERVICES

Our Website is hosted on Shopify. They provide us with the online e­commerce platform that allows us to sell our products and services to you. Accordingly, your data is stored through Shopify’s data storage, databases, and servers. They store your data on a secure server behind a firewall. 

We also user certain third party service providers in order to provide the Website and Services. For example, email marketing service providers or payment processors. In general, the third­party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third­party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase­related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your Personal Information will be handled by these providers. 

In particular, remember that certain providers, such as our payment processors Stripe, PayPal, and Shopify, may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third­party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your Personal Information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our Website or are redirected to a third­party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our Website, they may direct you away from our Website. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

 

SECTION 6 – PAYMENT INFORMATION

 If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI­DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. If you use another payment processor, such as PayPal or Stripe, then your purchase transaction information will be stored on their servers and will be subject to their Privacy Policy and Terms of Service.

 

SECTION 7 ­ SECURITY

 To protect your Personal Information, we take reasonable precautions and follow industry best practices to make sure it is not lost, misused, or inappropriately accessed, disclosed, altered or destroyed.

 If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES­256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI­DSS requirements and implement additional generally accepted industry standards.

 

SECTION 8 ­ COOKIES

Like many website owners and operators, we use automated data collection tools such as Cookies to collect certain information. “Cookies” are small text files that are placed on your hard drive by a Web server when you access our Services. We may use both session Cookies and persistent Cookies to identify that you’ve logged in to the Services and to tell us how and when you interact with our Services. We may also use Cookies to monitor aggregate usage and web traffic routing on our Services and to customize and improve our Services. Unlike persistent Cookies, session Cookies are deleted when you log off from the Services and close your browser. Our website also uses Google Analytics to help us learn about who visits our site and what pages are being looked at. All information collected through these means is impersonal, aggregate information.

 

SECTION 9 ­ AGE OF CONSENT

The Website and our Services are intended for use by individuals aged eighteen (18) and older. By using this Website, you represent that you are at least 18 years of age. We do not knowingly collect personally identifiable information from children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at info@lift-innovations.com. If we become aware that an individual under 13 has provided us with any Personal Information, we will take steps to delete such information.

 

SECTION 10 ­ CHANGES TO THIS PRIVACY POLICY

 We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our company is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

 

SECTION 11 - RETENTION

We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained Personal Information will remain subject to the terms of this Privacy Policy. If you request that your name be removed from our databases, it may not be possible to completely delete all your Personal Information due to technological and legal constraints.

 

SECTION 12 - ACCESS AND ACCURACY

You have the right to access the Personal Information we hold about you in order to verify the Personal Information we have collected in respect to you and to have a general account of our uses of that information. Upon receipt of your written request, we will provide you with a copy of your Personal Information although in certain limited circumstances, we may not be able to make all relevant information available to you such as where that information also pertains to another user. In such circumstances we will provide reasons for the denial to you upon request. We will endeavor to deal with all requests for access and modifications in a timely manner.

We will make every reasonable effort to keep your Personal Information accurate and up-to-date, and we will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate. As appropriate, this amended Personal Information will be transmitted to those parties to which we are permitted to disclose your information. Having accurate Personal Information about you enables us to give you the best possible service.
